A "Testament," commonly known as a will, is a legal document made by a person aged 18 or above who is of sound mind, specifying how their assets should be distributed after death. These assets may include bank deposits, property, stocks, jewellery, etc. A peace-of-mind paper only takes effect upon the testator’s death and is executed by an appointed executor who manages and distributes the estate according to the instructions in the document.

 

Home Affairs Department’s Services on Wills

The Home Affairs Department of Hong Kong does not provide services for drafting or handling wills (testament). Its Public Enquiry Service Centres only offer statutory declaration and oath services, which fall under a different legal framework. Wills are governed by the Wills Ordinance, while declarations are governed by the Oaths and Declarations Ordinance.

In reality, a testament and a will refer to the same document and carry no substantive difference. Both are legal tools used by individuals to arrange their affairs after death and ensure their estate is distributed according to personal wishes. To be legally valid, a will must follow statutory procedures, including signing in the presence of two witnesses who are not beneficiaries. It can be amended or revoked at any time to prevent future legal disputes.

 

Cost of Drafting a Testament

The cost of drafting a testament depends on the complexity of the document. A simple will prepared by a lawyer typically costs around HKD 1,000, while more complex wills may cost up to HKD 4,000 or more. Although you may write a will yourself without legal fees, it is strongly recommended to consult a lawyer to ensure legal validity and reduce the risk of disputes.

 

Role and Eligibility of an Executor

An executor is the person named in a will who is responsible for executing its contents and managing the estate. Their duties include settling debts, handling tax matters, and distributing assets according to the will. Under Hong Kong law, an executor must be at least 21 years old, mentally sound, and not currently imprisoned or bankrupt. Executors can also be beneficiaries—commonly, a spouse or adult children are appointed in family wills.

Choosing a trustworthy and capable executor is crucial to prevent mismanagement or misappropriation of the estate.
